Narrative:

Scheduled air carrier deviating around thunderstorms. Given permission by ZJX to enter warning area W-122. Permission then revoked and told turn 270 degree. Unable due to thunderstorms. Squawked XXXX and exercised emergency authority. Entered W-122 for 5 mins. No aircraft conflict. Flight at FL330. Military aircraft at FL310 holding. Controling agency needs to be a little more flexible when WX and scheduled air carrier flight crew. Could have restr the military aircraft to FL310 and below and worked both concerns.

CTLING AGENCY NEEDS TO BE A LITTLE MORE FLEXIBLE WHEN WX AND SCHEDULED AIR CARRIER FLT CREW. COULD HAVE RESTR THE MIL ACFT TO FL310 AND BELOW AND WORKED BOTH CONCERNS.
