Narrative:

Small aircraft X issued clearance to 3SY from ekm to maintain 3000' initial contact. 'Maintain 3000' restated and acknowledged. Small aircraft X later reported out of assigned altitude. Small transport Y was overhead at 4000', nwbnd for ILS approach at sbn. Pilot of small aircraft X instructed to maintain 3000'. Pilot left 3400' for assigned altitude. No action taken by small transport Y. I observed mode C reporting 3200'. Pilot advised in his climb at that time, less complexity and workload may have aided in catching situation sooner. However, difference would have only been about 100' earlier. Frequency congestion may have discouraged pilot from, again, verifying altitude assignment if unsure.

PLT ADVISED IN HIS CLB AT THAT TIME, LESS COMPLEXITY AND WORKLOAD MAY HAVE AIDED IN CATCHING SITUATION SOONER. HOWEVER, DIFFERENCE WOULD HAVE ONLY BEEN ABOUT 100' EARLIER. FREQUENCY CONGESTION MAY HAVE DISCOURAGED PLT FROM, AGAIN, VERIFYING ALT ASSIGNMENT IF UNSURE.
