Narrative:
Immediately after departure, tower turned us over to bos departure. The controller questioned negative mode C. I replied to the effect we had had a few complaints, intermittent. She responded to the effect 'that's the same as no mode C. You should have had a waiver.' the mode C unit has been removed from the aircraft for inspection/repair.

Title: IFR INTO TCA BY SMT WITHOUT TRANSPONDER MODE C IN OPERATION.
Narrative: IMMEDIATELY AFTER DEP, TWR TURNED US OVER TO BOS DEP. THE CTLR QUESTIONED NEGATIVE MODE C. I REPLIED TO THE EFFECT WE HAD HAD A FEW COMPLAINTS, INTERMITTENT. SHE RESPONDED TO THE EFFECT 'THAT'S THE SAME AS NO MODE C. YOU SHOULD HAVE HAD A WAIVER.' THE MODE C UNIT HAS BEEN REMOVED FROM THE ACFT FOR INSPECTION/REPAIR.
