Narrative:

On an IFR flight plan from zurich, switzerland to munich, west germany. 1) cancelled IFR 48 mi southwest of munich at 9000' MSL due to not having the specified arrival plate for arrival in use on board. (As it turned out, we did, but misunderstood approach control.) 2) we were advised to change frequencys after cancelling IFR and contact 'VFR control'. 3) we contacted control and were given a heading to fly, 'maintain 9000', and squawk '1234'. 4) after complying, we were advised that we just entered the controled VFR area (cvfr), and should have been under 5000' MSL. 5) we advised control that we were given 'maintain 9000' and we were maintaining. 6) we were then advised by control that 'it is the pilot's responsibility to be at the proper altitude in the area, and that we had 'clipped' the cvfr area.' corrective action was taken and we descended to below 5000'. Summation: german flight rules, controllers and accepted practice are not in universal accord with united states practices. Also, they are not consistent with the general practice in other parts of west germany (ie, frankfurt, hanover, ensheim or hamburg). Lesson learned: even if you comply with a controller, you may be wrong! In the same situation again, we should have advised that we were about to enter the cvfr area and that we were leaving 9000 for 4500'.

(AS IT TURNED OUT, WE DID, BUT MISUNDERSTOOD APCH CTL.) 2) WE WERE ADVISED TO CHANGE FREQS AFTER CANCELLING IFR AND CONTACT 'VFR CTL'. 3) WE CONTACTED CTL AND WERE GIVEN A HDG TO FLY, 'MAINTAIN 9000', AND SQUAWK '1234'. 4) AFTER COMPLYING, WE WERE ADVISED THAT WE JUST ENTERED THE CTLED VFR AREA (CVFR), AND SHOULD HAVE BEEN UNDER 5000' MSL. 5) WE ADVISED CTL THAT WE WERE GIVEN 'MAINTAIN 9000' AND WE WERE MAINTAINING. 6) WE WERE THEN ADVISED BY CTL THAT 'IT IS THE PLT'S RESPONSIBILITY TO BE AT THE PROPER ALT IN THE AREA, AND THAT WE HAD 'CLIPPED' THE CVFR AREA.' CORRECTIVE ACTION WAS TAKEN AND WE DESCENDED TO BELOW 5000'. SUMMATION: GERMAN FLT RULES, CTLRS AND ACCEPTED PRACTICE ARE NOT IN UNIVERSAL ACCORD WITH UNITED STATES PRACTICES. ALSO, THEY ARE NOT CONSISTENT WITH THE GENERAL PRACTICE IN OTHER PARTS OF WEST GERMANY (IE, FRANKFURT, HANOVER, ENSHEIM OR HAMBURG). LESSON LEARNED: EVEN IF YOU COMPLY WITH A CTLR, YOU MAY BE WRONG! IN THE SAME SITUATION AGAIN, WE SHOULD HAVE ADVISED THAT WE WERE ABOUT TO ENTER THE CVFR AREA AND THAT WE WERE LEAVING 9000 FOR 4500'.
