Narrative:

Near miss with small aircraft type aircraft while at 13,000' on the payson 5 departure from sky harbor (phx). Small aircraft was lime green and white, white lettering with single passenger. Our flight was on a 050 heading to join the salt river 030 radial. At 13 DME captain picked up small aircraft co-altitude opposite direction and took evasive action. Total miss was approximately 200' vertical and 800' horizontal. When ZAB was queried, they had not talked to the pilot nor had mode C. After our insistence and telephone discussion they were tracking the pilot so they could find out what he was doing. What is also significant is that the aircraft was hidden from first officer view by metal bow in windscreen. Valuable lesson about looking around beam but poor design.

Title: ACR DEPARTING PHX ON SID HAS CONFLICT WITH SMA AT 13,000' BECAUSE SMA HAD NO MODE C.

Narrative: NEAR MISS WITH SMA TYPE ACFT WHILE AT 13,000' ON THE PAYSON 5 DEP FROM SKY HARBOR (PHX). SMA WAS LIME GREEN AND WHITE, WHITE LETTERING WITH SINGLE PAX. OUR FLT WAS ON A 050 HDG TO JOIN THE SALT RIVER 030 RADIAL. AT 13 DME CAPT PICKED UP SMA CO-ALT OPPOSITE DIRECTION AND TOOK EVASIVE ACTION. TOTAL MISS WAS APPROX 200' VERTICAL AND 800' HORIZONTAL. WHEN ZAB WAS QUERIED, THEY HAD NOT TALKED TO THE PLT NOR HAD MODE C. AFTER OUR INSISTENCE AND TELEPHONE DISCUSSION THEY WERE TRACKING THE PLT SO THEY COULD FIND OUT WHAT HE WAS DOING. WHAT IS ALSO SIGNIFICANT IS THAT THE ACFT WAS HIDDEN FROM F/O VIEW BY METAL BOW IN WINDSCREEN. VALUABLE LESSON ABOUT LOOKING AROUND BEAM BUT POOR DESIGN.
