Narrative:
Aircraft X was assigned 35;000 feet because he was merging with aircraft Y at 36;000 feet. Both pilots were issued the traffic. As aircraft X was diverging from aircraft Y and about 3 miles south of aircraft Y I notice he breaks his assigned altitude and their mode C indicates 35;400 feet and climbing. As soon as I noticed the deviation I advised aircraft X he was only assigned 35;000 feet. He says he is level at 35;000 feet; and within one update the mode C was indicated level at 35;000 feet.

Narrative: Aircraft X was assigned 35;000 feet because he was merging with aircraft Y at 36;000 feet. Both pilots were issued the traffic.
