Narrative:

At 5000 feet and on radar vectors for landing at vny; a small single engine VFR aircraft traveling right to left of our position began to climb from 4500 feet into our altitude and flight path. ATC did not alert us to this but we observed it on our TCAS and we were monitoring its progress. When the aircraft was at our 12:30 position and at approximately 200 feet vertical and 1.5 miles horizontal we received an RA to climb. The PF immediately complied and climbed to 5800 feet. The pm notified ATC of the RA and ATC contacted the encroaching aircraft and directed it to immediately descend back to their assigned VFR altitude of 4500 feet. ATC further chastised the pilot for the RA. When we were clear of conflict the PF descended back to our assigned altitude of 5000 feet. The pm advised ATC that we would be reporting this RA via an as soon as possible report. ATC apologized and informed us that the encroaching aircraft was not supposed to climb but instead; was supposed to maintain their assigned altitude of 4500 feet. We landed safely with no further conflicts. TCAS initially alerted us to 'traffic; traffic' and then demanded a climb for the RA.
