Narrative:

While climbing out of smf on the dudes 7 departure, our flight was given clearance to 11000'. Approximately 30-45 seconds later the ZOA controller called out traffic at our 1-2 O'clock position, northbound at 9500', converging. Approximately 10 seconds later we were told to level at 9000' if we did not have visibility contact with the aircraft. We were now at 8000' and still climbing. At that time we made visibility contact and began our level off at 9000', even though we now had the aircraft in sight. About the time we leveled off at 9000' the other aircraft, a twin engine small transport Y, passed directly over us at what I believed to be 9500', or just 500' of sep. The controller was not in radio contact with the aircraft. Had ATC not called out the traffic and stopped our climb at 9000', there could possibly have been a disaster.

Narrative: WHILE CLBING OUT OF SMF ON THE DUDES 7 DEP, OUR FLT WAS GIVEN CLRNC TO 11000'. APPROX 30-45 SECS LATER THE ZOA CTLR CALLED OUT TFC AT OUR 1-2 O'CLOCK POS, NBND AT 9500', CONVERGING. APPROX 10 SECS LATER WE WERE TOLD TO LEVEL AT 9000' IF WE DID NOT HAVE VIS CONTACT WITH THE ACFT. WE WERE NOW AT 8000' AND STILL CLBING. AT THAT TIME WE MADE VIS CONTACT AND BEGAN OUR LEVEL OFF AT 9000', EVEN THOUGH WE NOW HAD THE ACFT IN SIGHT. ABOUT THE TIME WE LEVELED OFF AT 9000' THE OTHER ACFT, A TWIN ENG SMT Y, PASSED DIRECTLY OVER US AT WHAT I BELIEVED TO BE 9500', OR JUST 500' OF SEP. THE CTLR WAS NOT IN RADIO CONTACT WITH THE ACFT. HAD ATC NOT CALLED OUT THE TFC AND STOPPED OUR CLB AT 9000', THERE COULD POSSIBLY HAVE BEEN A DISASTER.
