Engine failure at 41000'. We were unable to maintain altitude. We asked for lower. They issued us 39000', but we had already gone through that. Basic procedure was we couldn't do as told!!

Title: SMT JET ACFT LOST 1 ENGINE AT FL410. UNABLE TO MAINTAIN ALT, REQUESTED LOWER. ARTCC CTLR GAVE FL390 BUT FLT WAS ALREADY BELOW THAT ALT.
Narrative: ENG FAILURE AT 41000'. WE WERE UNABLE TO MAINTAIN ALT. WE ASKED FOR LOWER. THEY ISSUED US 39000', BUT WE HAD ALREADY GONE THROUGH THAT. BASIC PROC WAS WE COULDN'T DO AS TOLD!!
