Narrative:
I arrived at the large transport in dfw. (The first officer was replaced by me.) my crew had already flown the aircraft to amarillo and back to dfw. I had reviewed the log book and saw a write-up concerning the landing gear (throttle activated) warning horn. It had been written up the night before in sarasota and was deferred to dfw where repairs were to be made. It was signed off by dfw maintenance as being ok for service. Actual write-up was as follows with subsequent sign-offs: 'when pulling back #3 throttle, takeoff warning horn sounds at 3000#.' sign-off by sarasota was approved for overnight. Maintenance at dfw fix was: 'complied with takeoff warning card, operations checks ok.' for myself, I had no idea what this card check included, but I had no information at my disposal to indicate any problem. We took the aircraft to sarasota after we had gone to ft myers. During descent to sarasota, I retarded the throttles and found the horn activated again at 3000#. I suggested we write it up again, and did so. The crew then went to the hotel. The following morning we returned to the airport to find the same aircraft to be awaiting us. We saw the sign-off, 'adjusted #3 throttle switch, ground check nrm' (sarasota). I went and found the mechanic to ask him as to why it was deferred by sarasota the night prior, and fixed the following night. He told me he had told home office he thought this to be a no-go item and was told by tulsa tech to defer it to dallas. Against his wishes he did so, but the following night convinced them to repair it. Unbeknownst to the crew as to the serious nature of the problem (no-go item) it was flown 5 legs.

Title: ACR LGT APPARENTLY FLOWN IN VIOLATION OF MINIMUM EQUIPMENT LIST REQUIREMENT.
Narrative: I ARRIVED AT THE LGT IN DFW. (THE F/O WAS REPLACED BY ME.) MY CREW HAD ALREADY FLOWN THE ACFT TO AMARILLO AND BACK TO DFW. I HAD REVIEWED THE LOG BOOK AND SAW A WRITE-UP CONCERNING THE LNDG GEAR (THROTTLE ACTIVATED) WARNING HORN. ACTUAL WRITE-UP WAS AS FOLLOWS WITH SUBSEQUENT SIGN-OFFS: 'WHEN PULLING BACK #3 THROTTLE, TKOF WARNING HORN SOUNDS AT 3000#.' SIGN-OFF BY SARASOTA WAS APPROVED FOR OVERNIGHT. HE TOLD ME HE HAD TOLD HOME OFFICE HE THOUGHT THIS TO BE A NO-GO ITEM AND WAS TOLD BY TULSA TECH TO DEFER IT TO DALLAS. AGAINST HIS WISHES HE DID SO, BUT THE FOLLOWING NIGHT CONVINCED THEM TO REPAIR IT. UNBEKNOWNST TO THE CREW AS TO THE SERIOUS NATURE OF THE PROB (NO-GO ITEM) IT WAS FLOWN 5 LEGS.
