Narrative:

Air carrier X informed controller that we would climb. He said no! RA said, 'climb now.' air carrier X climbed 300' and returned to 9000' after visibility contact and TCAS clear. Callback conversation with reporter revealed the following: reporter stated the TCASII system being used gives a lot of false targets. When the flight crew received the RA, they informed the controller they would climb. When the controller said 'no,' he did not issue traffic. Traffic was an medium large transport in a high rate of climb to assigned altitude 8000'.

Title: ACR X NON ADHERENCE TO ATC CLRNC TCASII RA EXCURSION FROM ASSIGNED ALT. PLT DEVIATION.

Narrative: ACR X INFORMED CTLR THAT WE WOULD CLB. HE SAID NO! RA SAID, 'CLB NOW.' ACR X CLBED 300' AND RETURNED TO 9000' AFTER VIS CONTACT AND TCAS CLR. CALLBACK CONVERSATION WITH RPTR REVEALED THE FOLLOWING: RPTR STATED THE TCASII SYS BEING USED GIVES A LOT OF FALSE TARGETS. WHEN THE FLT CREW RECEIVED THE RA, THEY INFORMED THE CTLR THEY WOULD CLB. WHEN THE CTLR SAID 'NO,' HE DID NOT ISSUE TFC. TFC WAS AN MLG IN A HIGH RATE OF CLB TO ASSIGNED ALT 8000'.
