Narrative:
We had departed morristown en route to 6n4 (60TH st heliport) in nyc. We called newark TCA at twin lakes (approximately 5 southeast mmu) requesting the newark route into nyc. We were given a squawk. At this time we were at 1400' and just crossing the ridgeline 7-8 DME west of ewr (newark). The controller then stated: unable newark route due to departures from runway 29, turn left descend to 800' cleared for the 280 route 800 or below. (We were 1/2 mi east of the ridgeline, paralleling the ridgeline north and had descended to 1200' as the controller was slow in issuing the clearance). Upon hearing the clearance we requested to remain at highest possible altitude (due to turbulence) for as long as possible. We were then told to descend immediately that we had already entered the TCA west/O a clearance. From what we saw visly, on the TCA chart, DME and LORAN we were still outside the controllers airspace during all this transaction. We joined the route and continued with no further incident.

Title: N90 CTLR ALLEGED HELICOPTER FLT CREW ENTERED TCA WITHOUT AUTH. FLT CREW PROTESTS.
Narrative: WE HAD DEPARTED MORRISTOWN ENRTE TO 6N4 (60TH ST HELIPORT) IN NYC. WE CALLED NEWARK TCA AT TWIN LAKES (APPROX 5 SE MMU) REQUESTING THE NEWARK RTE INTO NYC. WE WERE GIVEN A SQUAWK. AT THIS TIME WE WERE AT 1400' AND JUST XING THE RIDGELINE 7-8 DME W OF EWR (NEWARK). THE CTLR THEN STATED: UNABLE NEWARK RTE DUE TO DEPS FROM RWY 29, TURN L DSND TO 800' CLRED FOR THE 280 RTE 800 OR BELOW. (WE WERE 1/2 MI E OF THE RIDGELINE, PARALLELING THE RIDGELINE N AND HAD DSNDED TO 1200' AS THE CTLR WAS SLOW IN ISSUING THE CLRNC). UPON HEARING THE CLRNC WE REQUESTED TO REMAIN AT HIGHEST POSSIBLE ALT (DUE TO TURB) FOR AS LONG AS POSSIBLE. WE WERE THEN TOLD TO DSND IMMEDIATELY THAT WE HAD ALREADY ENTERED THE TCA W/O A CLRNC. FROM WHAT WE SAW VISLY, ON THE TCA CHART, DME AND LORAN WE WERE STILL OUTSIDE THE CTLRS AIRSPACE DURING ALL THIS TRANSACTION. WE JOINED THE RTE AND CONTINUED WITH NO FURTHER INCIDENT.
