Narrative:
We departed stl. Departure control said turn left 210 degree, maintain 6000 ft, intercept J101. Traffic was called at 6500 moving left to right. Additional traffic right to left at 7000 ft air carrier. There was a cloud layer at 6200 ft in that area. We received a TA on our TCAS. Then a RA on our TCAS. The traffic left to right had asked departure for a descent to stay clear of clouds (VFR). Departure said unable due to traffic. Our TCAS showed him descending into us. We received a RA and followed TCAS evasive maneuvering descended down to 5500 ft at which time I saw an small transport cross in front of us at 6000 ft, stl departure was informed of TCAS deviation and of the small transport not maintaining his altitude when he told stl departure 118.95 he was at 6500 ft. He subsequently informed stl departure he did descend to maintain VFR. Stl departure is in process of filing against small transport.

Narrative: WE DEPARTED STL. DEP CTL SAID TURN L 210 DEG, MAINTAIN 6000 FT, INTERCEPT J101. TFC WAS CALLED AT 6500 MOVING L TO R. ADDITIONAL TFC R TO L AT 7000 FT AIR CARRIER. THERE WAS A CLOUD LAYER AT 6200 FT IN THAT AREA. WE RECEIVED A TA ON OUR TCAS. THEN A RA ON OUR TCAS. THE TFC L TO R HAD ASKED DEP FOR A DSCNT TO STAY CLR OF CLOUDS (VFR). DEP SAID UNABLE DUE TO TFC. OUR TCAS SHOWED HIM DSNDING INTO US. WE RECEIVED A RA AND FOLLOWED TCAS EVASIVE MANEUVERING DSNDED DOWN TO 5500 FT AT WHICH TIME I SAW AN SMT CROSS IN FRONT OF US AT 6000 FT, STL DEP WAS INFORMED OF TCAS DEV AND OF THE SMT NOT MAINTAINING HIS ALT WHEN HE TOLD STL DEP 118.95 HE WAS AT 6500 FT. HE SUBSEQUENTLY INFORMED STL DEP HE DID DSND TO MAINTAIN VFR. STL DEP IS IN PROCESS OF FILING AGAINST SMT.
