Narrative:
On thur evening, 9/91, we were en route from anc to jfk. We were cruising at our assigned altitude of FL370. At approximately overhead the mans VOR (northwest of toronto) an air carrier Y flight questioned toronto center about our altitude. When the center advised them that we were at FL370, they told toronto that they were filing a report on toronto center for clearing them to FL390 which caused them to pass through our flight path. Evidently toronto center in a previous sector, had cleared them from FL350 to FL390. As they were climbing through FL380 en route to FL390, they passed over the top of us. We were unaware of the conflict until we heard their conversation. I am filing this report to assist in their reporting of the incident.

Title: ACR WDB OVERHEARD A SECOND ACR COMPLAIN THAT THEY HAD BEEN CLRED THROUGH THE RPTR'S ALT. TFC WAS SIGHTED OVERHEAD.
Narrative: ON THUR EVENING, 9/91, WE WERE ENRTE FROM ANC TO JFK. WE WERE CRUISING AT OUR ASSIGNED ALT OF FL370. AT APPROX OVERHEAD THE MANS VOR (NW OF TORONTO) AN ACR Y FLT QUESTIONED TORONTO CENTER ABOUT OUR ALT. WHEN THE CENTER ADVISED THEM THAT WE WERE AT FL370, THEY TOLD TORONTO THAT THEY WERE FILING A RPT ON TORONTO CENTER FOR CLRING THEM TO FL390 WHICH CAUSED THEM TO PASS THROUGH OUR FLT PATH. EVIDENTLY TORONTO CENTER IN A PREVIOUS SECTOR, HAD CLRED THEM FROM FL350 TO FL390. AS THEY WERE CLBING THROUGH FL380 ENRTE TO FL390, THEY PASSED OVER THE TOP OF US. WE WERE UNAWARE OF THE CONFLICT UNTIL WE HEARD THEIR CONVERSATION. I AM FILING THIS RPT TO ASSIST IN THEIR RPTING OF THE INCIDENT.
