Narrative:
Flight ord to msp. I was captain and PF. We were following a heavy aircraft on takeoff runway 32R. As the heavy started his takeoff roll I started my clock. O'hare tower cleared us to position and hold caution departing heavy. When we were cleared for takeoff only 1 min had elapsed and our heavy traffic was at 2 mi on the TCASII. This was clearly an unsafe situation so I delayed takeoff until I had a safe interval. This was not in accordance with the FARS on this subject since, 1) I did not indicate that I wanted to waive the wake turbulence separation, 2) this was nowhere near the recommended 2 mins, 3) the heavy was not at 5 mi radar, 4) the heavy was not even going to be 5 mi away from my takeoff position. My takeoff roll was going to take 30 seconds so the heavy would have to have had a ground speed of 8 mph in order to be 5 mi from me when my aircraft broke ground. I cannot allow a controller to jeopardize the safety of my aircraft so in the future I will always insist on the 2 mins as provided in the FARS.

Title: ACR LGT DELAYED IN POS ON THE RWY AT ORD FOR WAKE TURB SEPARATION FROM A PREVIOUSLY DEPARTING HVT.
Narrative: FLT ORD TO MSP. I WAS CAPT AND PF. WE WERE FOLLOWING A HVY ACFT ON TKOF RWY 32R. AS THE HVY STARTED HIS TKOF ROLL I STARTED MY CLOCK. O'HARE TWR CLRED US TO POS AND HOLD CAUTION DEPARTING HVY. WHEN WE WERE CLRED FOR TKOF ONLY 1 MIN HAD ELAPSED AND OUR HVY TFC WAS AT 2 MI ON THE TCASII. THIS WAS CLRLY AN UNSAFE SITUATION SO I DELAYED TKOF UNTIL I HAD A SAFE INTERVAL. THIS WAS NOT IN ACCORDANCE WITH THE FARS ON THIS SUBJECT SINCE, 1) I DID NOT INDICATE THAT I WANTED TO WAIVE THE WAKE TURB SEPARATION, 2) THIS WAS NOWHERE NEAR THE RECOMMENDED 2 MINS, 3) THE HVY WAS NOT AT 5 MI RADAR, 4) THE HVY WAS NOT EVEN GOING TO BE 5 MI AWAY FROM MY TKOF POS. MY TKOF ROLL WAS GOING TO TAKE 30 SECONDS SO THE HVY WOULD HAVE TO HAVE HAD A GND SPD OF 8 MPH IN ORDER TO BE 5 MI FROM ME WHEN MY ACFT BROKE GND. I CANNOT ALLOW A CTLR TO JEOPARDIZE THE SAFETY OF MY ACFT SO IN THE FUTURE I WILL ALWAYS INSIST ON THE 2 MINS AS PROVIDED IN THE FARS.
