Narrative:
Air carrier X having departed runway 13, I plted through the whitestone climb. Upon turning to 040 degree heading (which takes us across the runway 13 extended centerline) the TCASII TA/RA'ed us to descend 1500 FPM. We immediately complied and looked at 9 O'clock to see a frontal view of air carrier Y in a climb on a collision course. Air carrier Y did not give any evasive action. Lga ATC released air carrier Y VFR which departed runway 13 straight out. The nature of the environment: lga TCA, and the irregularity of a VFR airline departure mixed with an IFR SID departure did not mix. Only the TCASII TA/RA brought the imminent conflict to our attention. After the situation was resolved, lga departure said that the tower had us both in sight. This further complicates the matter because why would ATC clear a VFR aircraft to fly across an active IFR SID! Immediate action to follow the TCASII RA was highly critical in the successful evasion of a midair collision. The evasive action was enough to be noticeable to the flight attendant and passenger.

Title: ACR X TCASII TA RA DSND HAD CONFLICT WITH ACR Y. EVASIVE ACTION TAKEN. SEE AND AVOID CONCEPT. VISUAL SEPARATION.
Narrative: ACR X HAVING DEPARTED RWY 13, I PLTED THROUGH THE WHITESTONE CLB. UPON TURNING TO 040 DEG HDG (WHICH TAKES US ACROSS THE RWY 13 EXTENDED CTRLINE) THE TCASII TA/RA'ED US TO DSND 1500 FPM. WE IMMEDIATELY COMPLIED AND LOOKED AT 9 O'CLOCK TO SEE A FRONTAL VIEW OF ACR Y IN A CLB ON A COLLISION COURSE. ACR Y DID NOT GIVE ANY EVASIVE ACTION. LGA ATC RELEASED ACR Y VFR WHICH DEPARTED RWY 13 STRAIGHT OUT. THE NATURE OF THE ENVIRONMENT: LGA TCA, AND THE IRREGULARITY OF A VFR AIRLINE DEP MIXED WITH AN IFR SID DEP DID NOT MIX. ONLY THE TCASII TA/RA BROUGHT THE IMMINENT CONFLICT TO OUR ATTN. AFTER THE SITUATION WAS RESOLVED, LGA DEP SAID THAT THE TWR HAD US BOTH IN SIGHT. THIS FURTHER COMPLICATES THE MATTER BECAUSE WHY WOULD ATC CLR A VFR ACFT TO FLY ACROSS AN ACTIVE IFR SID! IMMEDIATE ACTION TO FOLLOW THE TCASII RA WAS HIGHLY CRITICAL IN THE SUCCESSFUL EVASION OF A MIDAIR COLLISION. THE EVASIVE ACTION WAS ENOUGH TO BE NOTICEABLE TO THE FLT ATTENDANT AND PAX.
