Narrative:
Air carrier X at 27000 ft cruise altitude on the mco 309 degree radial at 85 DME approximately over cross city. We had a TCASII RA and responded with a climb to 27600 ft. The TCASII showed a TA at 9 O'clock with an aural 'traffic' call warning. ATC was notified but at the same time we received an RA with an aural 'climb' command given by the TCASII. We were unable to locate the traffic visually so a climb was initiated and ATC was informed. We climbed to 27600 ft and then descended back down to 27000 ft. At the time we were climbing, ATC stated that the traffic was at 28000 ft. Our TCASII showed the traffic at 400 ft below our altitude (26600 ft). ATC advised an altitude deviation would be filed. The captain called ATC by phone and was told that the traffic was an light transport. ATC also informed us that the light transport's transponder mode C had malfunctioned earlier when he leveled at 15000 ft it showed him at 13500 ft (1500 ft lower than he was). We were told he was supposed to have his mode C turned off but it was obviously on for us to receive a TCASII warning (RA).

Title: LTT NON ADHERENCE TO ATC INSTRUCTION ACFT EQUIP PROB ERRONEOUS MODE C CAUSED ACR X TCASII RA CLB. ACR X HAD LTSS FROM LTT. PLTDEV.
Narrative: ACR X AT 27000 FT CRUISE ALT ON THE MCO 309 DEG RADIAL AT 85 DME APPROX OVER CROSS CITY. WE HAD A TCASII RA AND RESPONDED WITH A CLB TO 27600 FT. THE TCASII SHOWED A TA AT 9 O'CLOCK WITH AN AURAL 'TFC' CALL WARNING. ATC WAS NOTIFIED BUT AT THE SAME TIME WE RECEIVED AN RA WITH AN AURAL 'CLB' COMMAND GIVEN BY THE TCASII. WE WERE UNABLE TO LOCATE THE TFC VISUALLY SO A CLB WAS INITIATED AND ATC WAS INFORMED. WE CLBED TO 27600 FT AND THEN DSNDED BACK DOWN TO 27000 FT. AT THE TIME WE WERE CLBING, ATC STATED THAT THE TFC WAS AT 28000 FT. OUR TCASII SHOWED THE TFC AT 400 FT BELOW OUR ALT (26600 FT). ATC ADVISED AN ALTDEV WOULD BE FILED.
