Narrative:
Tpa approach and pie tower have entered into a LOA that causes system deviations with the spg air traffic area 6 mi south of pie. The pie 2 SID instructs aircraft to fly 170 degrees until 3.5 DME, then turn right heading 200 degree. When turbojets use this departure and are not radar identify because of ARTS problems, traffic congestion etc, these aircraft stay at 1600 ft and penetrate the spg air traffic area. This has happened many times to myself and other controllers. I have turned myself in numerous times for having deviated spg air traffic area with my supervisor and area manager and have been told it's a non problem.

Title: CTLR COMPLAINS ABOUT AN IFR DEP THAT MAY ENCOURAGE SOME ACFT TO PENETRATE ADJACENT FACILITY AIRSPACE WITHOUT AUTHORIZATION OR COORD.
Narrative: TPA APCH AND PIE TWR HAVE ENTERED INTO A LOA THAT CAUSES SYS DEVS WITH THE SPG ATA 6 MI S OF PIE. THE PIE 2 SID INSTRUCTS ACFT TO FLY 170 DEGS UNTIL 3.5 DME, THEN TURN R HDG 200 DEG. WHEN TURBOJETS USE THIS DEP AND ARE NOT RADAR IDENT BECAUSE OF ARTS PROBS, TFC CONGESTION ETC, THESE ACFT STAY AT 1600 FT AND PENETRATE THE SPG ATA. THIS HAS HAPPENED MANY TIMES TO MYSELF AND OTHER CTLRS. I HAVE TURNED MYSELF IN NUMEROUS TIMES FOR HAVING DEVIATED SPG ATA WITH MY SUPVR AND AREA MGR AND HAVE BEEN TOLD IT'S A NON PROB.
