Narrative:

During preflight, maintenance was deferring the vsi. The MEL states it is ok as long as day and VFR conditions exist. I informed maintenance we fly on instrument flight plans and talked to dispatch. Dispatch determined flight was legal. I informed the chief pilot and the senior director of operations and both determined flight was legal. Since the senior director of operations and the chief pilot have operational control of airline and said flight was legal, the flight was conducted. My company said it was going to have the wording changed from VFR to VMC in the MEL. Supplemental information from acn 249807: the director of operations said that an incorrect decision was made by the previous company personnel. The aircraft was removed from service to be fixed.

Title: AN ACR LTT FLEW A TRIP WITH AN INOP VSI AGAINST THE BEST WISHES OF THE FLC.

Narrative: DURING PREFLT, MAINT WAS DEFERRING THE VSI. THE MEL STATES IT IS OK AS LONG AS DAY AND VFR CONDITIONS EXIST. I INFORMED MAINT WE FLY ON INST FLT PLANS AND TALKED TO DISPATCH. DISPATCH DETERMINED FLT WAS LEGAL. I INFORMED THE CHIEF PLT AND THE SENIOR DIRECTOR OF OPS AND BOTH DETERMINED FLT WAS LEGAL. SINCE THE SENIOR DIRECTOR OF OPS AND THE CHIEF PLT HAVE OPERATIONAL CTL OF AIRLINE AND SAID FLT WAS LEGAL, THE FLT WAS CONDUCTED. MY COMPANY SAID IT WAS GOING TO HAVE THE WORDING CHANGED FROM VFR TO VMC IN THE MEL. SUPPLEMENTAL INFORMATION FROM ACN 249807: THE DIRECTOR OF OPS SAID THAT AN INCORRECT DECISION WAS MADE BY THE PREVIOUS COMPANY PERSONNEL. THE ACFT WAS REMOVED FROM SVC TO BE FIXED.
