Narrative:
New york approach cleared our aircraft to descend from 9000 ft to 4000 ft approximately 34 mi (338 degree radial) northwest of dpk VOR on the extol arrival. The conflict arose when our aircraft was descending through 8000 ft (approximately 7700 ft) over haarp intersection. Another aircraft at 7000 ft passed left to right within approximately 1 mi. Both aircraft on IFR flight plans. TCASII and controller both said climb back to 8000 ft at the same time. We climbed back to 8000 ft as soon as possible. Clear of conflict. Controller responded we were only cleared to 8000 ft. We heard and read back to the controller cleared to 4000 ft. When controller erred in the clearance altitude he should have caught his error when we read back the altitude to which we were cleared.

Narrative: NEW YORK APCH CLRED OUR ACFT TO DSND FROM 9000 FT TO 4000 FT APPROX 34 MI (338 DEG RADIAL) NW OF DPK VOR ON THE EXTOL ARR. TCASII AND CTLR BOTH SAID CLB BACK TO 8000 FT AT THE SAME TIME. WE CLBED BACK TO 8000 FT ASAP. CLR OF CONFLICT. CTLR RESPONDED WE WERE ONLY CLRED TO 8000 FT. WE HEARD AND READ BACK TO THE CTLR CLRED TO 4000 FT. WHEN CTLR ERRED IN THE CLRNC ALT HE SHOULD HAVE CAUGHT HIS ERROR WHEN WE READ BACK THE ALT TO WHICH WE WERE CLRED.
