Narrative:
Small transport X departed myf runway 28, was given radar contact and cleared to 4000 ft. Approximately 4 mi west of myf traffic was called, 'small transport X, traffic 1 O'clock, 1 mi, sbound, indicates 3500 ft, say altitude.' small transport X replied, 'in sight.' small transport X was then cleared direct ocn, resume own navigation. Small transport X was then asked to 'squawk altitude, no mode C received.' when mode C came on, altitude was verified and frequency change was given to next sector. The pilot later called to file near midair with the VFR traffic that was issued to him.

Title: DEP CTLR ISSUED UNKNOWN VFR TFC TO IFR SMT IN CLB OFF MYF. SMT ADVISED TFC IN SIGHT AND THEN LATER RPTED AN NMAC.
Narrative: SMT X DEPARTED MYF RWY 28, WAS GIVEN RADAR CONTACT AND CLRED TO 4000 FT. APPROX 4 MI W OF MYF TFC WAS CALLED, 'SMT X, TFC 1 O'CLOCK, 1 MI, SBOUND, INDICATES 3500 FT, SAY ALT.' SMT X REPLIED, 'IN SIGHT.' SMT X WAS THEN CLRED DIRECT OCN, RESUME OWN NAV. SMT X WAS THEN ASKED TO 'SQUAWK ALT, NO MODE C RECEIVED.' WHEN MODE C CAME ON, ALT WAS VERIFIED AND FREQ CHANGE WAS GIVEN TO NEXT SECTOR. THE PLT LATER CALLED TO FILE NEAR MIDAIR WITH THE VFR TFC THAT WAS ISSUED TO HIM.
