Narrative:

Cruising at 37000 ft, went to do an engine check, got clearance to FL390, reaching 38700 ft, right engine flamed out. We pushed the nose over so left engine wouldn't flame out. During all of this, the controller was speaking to another aircraft and we descended to FL350. Told the controller what situation was. The problem I have is we descended to FL350 without permission because controller was talking, and we needed to get down right then. Finally made communication with ATC to descend to FL350, then down to FL280 and relit the #2 engine. During all of this, we did not declare an emergency. (I'm just concerned about leaving 38700 ft without ATC clearance to FL350!)

Title: 1 ENG FLAMED OUT DURING HIGH ALT CRUISE RESULTING IN LOSS OF ALT.

Narrative: CRUISING AT 37000 FT, WENT TO DO AN ENG CHK, GOT CLRNC TO FL390, REACHING 38700 FT, R ENG FLAMED OUT. WE PUSHED THE NOSE OVER SO L ENG WOULDN'T FLAME OUT. THE PROB I HAVE IS WE DSNDED TO FL350 WITHOUT PERMISSION BECAUSE CTLR WAS TALKING, AND WE NEEDED TO GET DOWN RIGHT THEN. FINALLY MADE COM WITH ATC TO DSND TO FL350, THEN DOWN TO FL280 AND RELIT THE #2 ENG. DURING ALL OF THIS, WE DID NOT DECLARE AN EMER. (I'M JUST CONCERNED ABOUT LEAVING 38700 FT WITHOUT ATC CLRNC TO FL350!)
