Narrative:

On night departure from sjc runway 30L copilot flying -- turn was delayed to right as required due to traffic departed earlier from runway 30R. Copilot commenced turn at 2000 ft and 2.2 DME instead of 1.8 indicating he needed separation from traffic beneath in the turn. A TA followed by a RA subsequently resulted to monitor vertical descent. At this time departure control instructed us of TA maintenance altitude. With a climb of 3000 FPM I tried to confirm intent and soon after we spotted traffic above opposite direction. In turn approximately 4500 ft. Copilot slowed climb and increased turn inside traffic and cleared conflict. 2ND traffic did not appear on TCASII.
