Narrative:

Description of incident: climbing to FL310. ATC stopped our climb at 5000 ft for inbound DC10 who was stopped in his descent at 6000 ft. We were on 155 degree heading. About the time he appeared on the TCASII screen at 2 O'clock position and plus 0.7 descending, we were given a vector of 240 degrees and told to climb to FL310. We got a TA when he was about 3 mi at 1 O'clock position, at which time departure control gave us a vector of 260 degrees. Almost simultaneously, we mentioned traffic at 2 O'clock position. We turned leisurely so as to not close separation too much, but we still crossed altitudes within 2 mi as shown on the TCASII. We got a visual on him through the clouds tail on at 3 O'clock position and just under 2 mi. We had no RA. First officer turned left momentarily, and we told controller that it was a little close. He rogered.

WE GOT A TA WHEN HE WAS ABOUT 3 MI AT 1 O'CLOCK POS, AT WHICH TIME DEP CTL GAVE US A VECTOR OF 260 DEGS. ALMOST SIMULTANEOUSLY, WE MENTIONED TFC AT 2 O'CLOCK POS. WE TURNED LEISURELY SO AS TO NOT CLOSE SEPARATION TOO MUCH, BUT WE STILL CROSSED ALTS WITHIN 2 MI AS SHOWN ON THE TCASII. WE GOT A VISUAL ON HIM THROUGH THE CLOUDS TAIL ON AT 3 O'CLOCK POS AND JUST UNDER 2 MI. WE HAD NO RA. FO TURNED L MOMENTARILY, AND WE TOLD CTLR THAT IT WAS A LITTLE CLOSE. HE ROGERED.
