Narrative:

I was pulled over by local police in tennessee for speeding. I was asked to take a breathalizer test and I refused. I was convicted of implied consent in that state. I was never convicted of operating a motor vehicle while intoxicated, impaired or under the influence. I have never had a tennessee driver's license. I have an ohio driver's license which has never been revoked, canceled or suspended. I received a letter from the FAA stating that I had a motor vehicle action in tennessee 4 1/2 yrs ago and did not notify the FAA within 60 days of conviction dec/mon/90. They also stated that I have not answered the questions on my medical application concerning convictions honestly. Now the FAA is trying to investigate for non-compliance of far's 61.15 and 67.20. The far's are broad and does not state that implied consent is a motor vehicle action.

Title: POLICE ACTION. RPTR CONVICTED UNDER IMPLIED CONSENT OF DRIVING UNDER THE INFLUENCE. FAILED TO RPT IT TO FAA.

Narrative: I WAS PULLED OVER BY LCL POLICE IN TENNESSEE FOR SPEEDING. I WAS ASKED TO TAKE A BREATHALIZER TEST AND I REFUSED. I WAS CONVICTED OF IMPLIED CONSENT IN THAT STATE. I WAS NEVER CONVICTED OF OPERATING A MOTOR VEHICLE WHILE INTOXICATED, IMPAIRED OR UNDER THE INFLUENCE. I HAVE NEVER HAD A TENNESSEE DRIVER'S LICENSE. I HAVE AN OHIO DRIVER'S LICENSE WHICH HAS NEVER BEEN REVOKED, CANCELED OR SUSPENDED. I RECEIVED A LETTER FROM THE FAA STATING THAT I HAD A MOTOR VEHICLE ACTION IN TENNESSEE 4 1/2 YRS AGO AND DID NOT NOTIFY THE FAA WITHIN 60 DAYS OF CONVICTION DEC/MON/90. THEY ALSO STATED THAT I HAVE NOT ANSWERED THE QUESTIONS ON MY MEDICAL APPLICATION CONCERNING CONVICTIONS HONESTLY. NOW THE FAA IS TRYING TO INVESTIGATE FOR NON-COMPLIANCE OF FAR'S 61.15 AND 67.20. THE FAR'S ARE BROAD AND DOES NOT STATE THAT IMPLIED CONSENT IS A MOTOR VEHICLE ACTION.
