Narrative:
Departing sjc (san jose, ca) ATC began to give vectors prior to completing the SID. PNF read back 'proceed direct to sjc VOR, cross at or above 12000 ft climb and maintain FL230.' after crossing sjc VOR at approximately 13500-14000 ft, and being switched to the next controller, ATC advised we should have crossed sjc VOR prior to climbing from 12000 ft. I believe this resulted because ATC had us deviate from the SID and pilot/controller miscoms.

Title: ALT XING - FLC CLBS THROUGH THEIR XING RESTR.
Narrative: DEPARTING SJC (SAN JOSE, CA) ATC BEGAN TO GIVE VECTORS PRIOR TO COMPLETING THE SID. PNF READ BACK 'PROCEED DIRECT TO SJC VOR, CROSS AT OR ABOVE 12000 FT CLB AND MAINTAIN FL230.' AFTER XING SJC VOR AT APPROX 13500-14000 FT, AND BEING SWITCHED TO THE NEXT CTLR, ATC ADVISED WE SHOULD HAVE CROSSED SJC VOR PRIOR TO CLBING FROM 12000 FT.
