Narrative:
Ewr departure issued a climb from 4000 ft to 6000 ft, expedite through 5000 ft, we complied. We were then asked if we got the 4000 ft altitude assignment. We replied that we did and were level at 4000 ft until starting the requested climb. Apparently our altitude was being encoded as 4700 ft. We were switched to the next controller and asked him for an altitude report. He showed us 500 ft too high. We switched to the #2 encoder and reported and MEL logged the faulty encoder #1 at the next down line station, albany, ny.

Title: ACFT EQUIP PROB. ACR XPONDER MODE C READ 500-700 FT HIGH. SWITCHED TO ANOTHER XPONDER.
Narrative: EWR DEP ISSUED A CLB FROM 4000 FT TO 6000 FT, EXPEDITE THROUGH 5000 FT, WE COMPLIED. WE WERE THEN ASKED IF WE GOT THE 4000 FT ALT ASSIGNMENT.
