Narrative:
Scheduled service dtw-lax on departure toward stl. Mid climb, altitude 13000 ft. Center called traffic 2 O'clock, 10 mi, 10000 ft. I called traffic in sight. Center advised traffic would pass underneath us. Traffic, a cargo 301 sabreliner/falcon jet, began high performance climbing left turn toward my aircraft. As traffic approached my altitude my TCASII traffic alerted 'traffic.' as traffic climbed through my altitude I initiated an evasive descent while TCASII switched to RA 'monitor vertical speed, descend' then, 'increase descent.' traffic passed 200 ft above and our flight paths crossed. After clear of traffic I queried ZOB about traffic, they claimed traffic was cleared underneath us and that we should climb. I told them traffic had passed above us, and that we had received TCASII RA's instructing descent. ZOB immediately switched us to ZAU before I could discuss it further. Problem: near miss. Cause: air cargo 301 turning into us. Solution: aircraft should be on same frequency when that close. Did not appear cargo aircraft was on the same frequency. Aircraft Y should not have flown into my flight path.

Narrative: SCHEDULED SVC DTW-LAX ON DEP TOWARD STL. MID CLB, ALT 13000 FT. CTR CALLED TFC 2 O'CLOCK, 10 MI, 10000 FT. I CALLED TFC IN SIGHT. CTR ADVISED TFC WOULD PASS UNDERNEATH US. TFC, A CARGO 301 SABRELINER/FALCON JET, BEGAN HIGH PERFORMANCE CLBING L TURN TOWARD MY ACFT. AS TFC APCHED MY ALT MY TCASII TFC ALERTED 'TFC.' AS TFC CLBED THROUGH MY ALT I INITIATED AN EVASIVE DSCNT WHILE TCASII SWITCHED TO RA 'MONITOR VERT SPD, DSND' THEN, 'INCREASE DSCNT.' TFC PASSED 200 FT ABOVE AND OUR FLT PATHS CROSSED. AFTER CLR OF TFC I QUERIED ZOB ABOUT TFC, THEY CLAIMED TFC WAS CLRED UNDERNEATH US AND THAT WE SHOULD CLB. I TOLD THEM TFC HAD PASSED ABOVE US, AND THAT WE HAD RECEIVED TCASII RA'S INSTRUCTING DSCNT. ZOB IMMEDIATELY SWITCHED US TO ZAU BEFORE I COULD DISCUSS IT FURTHER. PROB: NEAR MISS. CAUSE: AIR CARGO 301 TURNING INTO US. SOLUTION: ACFT SHOULD BE ON SAME FREQ WHEN THAT CLOSE. DID NOT APPEAR CARGO ACFT WAS ON THE SAME FREQ. ACFT Y SHOULD NOT HAVE FLOWN INTO MY FLT PATH.
