Narrative:
ATC issued speed restrs and captain did not obey. This captain refuses to fly 250 KTS or less below 10000 ft. The airspace over the hawaiian islands outside of 3 mi from land used to be considered international and hence was not restr. A couple of different interps have come up over the yrs with the current company endorsed plan being 250 KTS below 10000 ft everywhere, but this particular captain does not abide by the current ruling.

Title: CAPT OF AN MLG ROUTINELY EXCEEDS THE AIRSPD LIMITATION BELOW 10000 FT SINCE HE BELIEVES THAT HE IS PERMITTED TO BEYOND 3 MI OF THE USA COASTAL WATERS.
Narrative: ATC ISSUED SPD RESTRS AND CAPT DID NOT OBEY. THIS CAPT REFUSES TO FLY 250 KTS OR LESS BELOW 10000 FT. THE AIRSPACE OVER THE HAWAIIAN ISLANDS OUTSIDE OF 3 MI FROM LAND USED TO BE CONSIDERED INTL AND HENCE WAS NOT RESTR. A COUPLE OF DIFFERENT INTERPS HAVE COME UP OVER THE YRS WITH THE CURRENT COMPANY ENDORSED PLAN BEING 250 KTS BELOW 10000 FT EVERYWHERE, BUT THIS PARTICULAR CAPT DOES NOT ABIDE BY THE CURRENT RULING.
