Narrative:
We were at FL280 20 NM south of bne at XA29Z, french ATC handed us off to london center. We reported to london level at FL280. London responded to maintain FL310 and reclred us on our flight plan route. We initiated climb to FL310. At about FL304 we saw air carrier Y flight at FL310 at our 3 O'clock position, converging. We began evasive action on our own seconds before TCASII advised us of the conflict. London ATC then gave us a heading of 350 degrees and to maintain FL290. The 350 degree heading in our opinion was not a good heading to resolve the conflict. We had already turned beyond that on our own because we had visual contact. ATC then gave us a 330 degrees as near as I can recall and we leveled at FL290. Air carrier X also took evasive action. Our maximum altitude was FL307 and we estimate distance between aircraft to be .5 to 1 mi at the closest point. London ATC accepted our clearance readback of maintain FL310 and never called a traffic conflict as we climbed from FL280 to FL310. We had already initiated evasive action when ATC intervened with their clearance.

Title: ACR WDB GIVEN CLB FROM FL280 TO FL310 ON INITIAL CONTACT WITH EGTT ARTCC. SHORTLY AFTER CLB WAS STARTED THE WDB SAW ANOTHER ACR AT THEIR 3 O'CLOCK POS AT FL310 AND THIS WAS CONFIRMED ON THEIR TCASII. THE WDB CREW TOOK EVASIVE ACTION OF A TURN AND ATC GAVE A TURN AND DSCNT AT THE SAME TIME. LTSS OCCURRED SHORTLY THEREAFTER.
