Narrative:

Short final we noticed a split flap and decided to go around. On go around the gear failed to retract. We landed with split flaps and gear down. On downwind/base turn, I recommended to captain that we declare an emergency because of our flight control malfunction. He chose not to. Because of the time constraints and his attention to the emergency flap extension procedure with a brand new, first flight off flight engineer, I did not press the issue. He did inform the tower of our flight control malfunction so they rolled the crash fire rescue equipment for us. However, I believe we were incorrect to not formally declare an emergency. Callback conversation with reporter revealed the following information: the aircraft had no roll associated with the split flaps, and the reporter believes the flaps shut off because the outboard flaps were coming down ahead of the inboard flaps. The left main gear was the one landing gear that would not retract, so the flight crew left all the gear down. The reporter had no information from maintenance on the cause of the flap or gear problem, but does know the aircraft was taken OTS and jacked.

Title: A B727-200 ON SHORT FINAL HAD SPLIT FLAP INDICATION. ON GAR WERE UNABLE TO RETRACT THE L MAIN LNDG GEAR. FO RECOMMENDED DECLARING EMER. CAPT DENIED.

Narrative: SHORT FINAL WE NOTICED A SPLIT FLAP AND DECIDED TO GO AROUND. ON GAR THE GEAR FAILED TO RETRACT. WE LANDED WITH SPLIT FLAPS AND GEAR DOWN. ON DOWNWIND/BASE TURN, I RECOMMENDED TO CAPT THAT WE DECLARE AN EMER BECAUSE OF OUR FLT CTL MALFUNCTION. HE CHOSE NOT TO. BECAUSE OF THE TIME CONSTRAINTS AND HIS ATTN TO THE EMER FLAP EXTENSION PROC WITH A BRAND NEW, FIRST FLT OFF FE, I DID NOT PRESS THE ISSUE. HE DID INFORM THE TWR OF OUR FLT CTL MALFUNCTION SO THEY ROLLED THE CFR FOR US. HOWEVER, I BELIEVE WE WERE INCORRECT TO NOT FORMALLY DECLARE AN EMER. CALLBACK CONVERSATION WITH RPTR REVEALED THE FOLLOWING INFO: THE ACFT HAD NO ROLL ASSOCIATED WITH THE SPLIT FLAPS, AND THE RPTR BELIEVES THE FLAPS SHUT OFF BECAUSE THE OUTBOARD FLAPS WERE COMING DOWN AHEAD OF THE INBOARD FLAPS. THE L MAIN GEAR WAS THE ONE LNDG GEAR THAT WOULD NOT RETRACT, SO THE FLC LEFT ALL THE GEAR DOWN. THE RPTR HAD NO INFO FROM MAINT ON THE CAUSE OF THE FLAP OR GEAR PROB, BUT DOES KNOW THE ACFT WAS TAKEN OTS AND JACKED.
