Narrative:

I briefed the air carrier inspector before we left the chocks that I had difficulty raising the gear with my shoulder harness on and that I would be taking off with my harness off. I made the takeoff with my harness not on. The inspector questioned me about it and I thought we had resolved the matter, and as he left, he said great job, and then apparently decided to do otherwise.

Title: CAPT OF AN LGT FAILED TO WEAR SHOULDER HARNESS FOR TKOF BECAUSE HE SAID IT WOULD BE DIFFICULT TO RAISE THE LNDG GEAR! FAA INSPECTOR ON A RTE SURVEILLANCE SUBSEQUENTLY CITED RPTR FOR VIOLATING FAR FOR NOT WEARING HIS SHOULDER HARNESS EVEN THOUGH SECTION 91 PT 105(B)(2) PROVIDES FOR THIS TYPE OF CIRCUMSTANCE IN WHICH THE CREW MEMBER IS UNABLE TO PERFORM REQUIRED DUTIES.

Narrative: I BRIEFED THE ACR INSPECTOR BEFORE WE LEFT THE CHOCKS THAT I HAD DIFFICULTY RAISING THE GEAR WITH MY SHOULDER HARNESS ON AND THAT I WOULD BE TAKING OFF WITH MY HARNESS OFF. I MADE THE TKOF WITH MY HARNESS NOT ON. THE INSPECTOR QUESTIONED ME ABOUT IT AND I THOUGHT WE HAD RESOLVED THE MATTER, AND AS HE LEFT, HE SAID GREAT JOB, AND THEN APPARENTLY DECIDED TO DO OTHERWISE.
