Narrative:
The flight was headed 120 degrees and climbing through 5000 ft and was given the following clearance: 'call sign, pilot's discretion turn right to the VOR, cross the sjc VOR at 12000 ft, climb and maintain FL230.' in my mind the issue was to get the aircraft turned toward the VOR, but not until I was sure I could make 12000 ft MSL by the VOR. Well, I made it with 5 mi to spare, and just kept climbing. When we were switched to ZOA, the controller informed us we were to cross the VOR at 12000 ft MSL. Looking back, the departure controller's were pretty clear, but my interpretation at the time convinced me that I had to hurry and get through 12000 ft MSL before crossing the VOR. In other words, I didn't hear what I thought I heard. The first officer even asked if I wanted him to set 12000 ft or FL230 in the altitude window. I said 'set FL230,' but next time I will probably opt for 12000 ft. Supplemental information from acn 375000: no visual conflict was noted with other aircraft, and after passing 12000 ft prior to the VOR, we were advised by ATC to level at 13000 ft.

Title: A B727 FREIGHTER CREW PERFORMING A LOUPE 9 SID CROSSED SJC ABOVE THE 12000 FT RESTR. THE CAPT ADMITS THAT HE MISINTERPED THE CLRNC.
Narrative: THE FLT WAS HEADED 120 DEGS AND CLBING THROUGH 5000 FT AND WAS GIVEN THE FOLLOWING CLRNC: 'CALL SIGN, PLT'S DISCRETION TURN R TO THE VOR, CROSS THE SJC VOR AT 12000 FT, CLB AND MAINTAIN FL230.' IN MY MIND THE ISSUE WAS TO GET THE ACFT TURNED TOWARD THE VOR, BUT NOT UNTIL I WAS SURE I COULD MAKE 12000 FT MSL BY THE VOR. WELL, I MADE IT WITH 5 MI TO SPARE, AND JUST KEPT CLBING. WHEN WE WERE SWITCHED TO ZOA, THE CTLR INFORMED US WE WERE TO CROSS THE VOR AT 12000 FT MSL. LOOKING BACK, THE DEP CTLR'S WERE PRETTY CLR, BUT MY INTERP AT THE TIME CONVINCED ME THAT I HAD TO HURRY AND GET THROUGH 12000 FT MSL BEFORE XING THE VOR.
