Narrative:

After takeoff and cleared to 10000 ft, just prior to level off, we requested a 10-15 degree turn to left to avoid a small cell. Departure approved the turn. While in the climb and turn, departure said pop-up traffic cleared to descend. Traffic was at 10500 ft and we were passing through 9700 ft. Tried to level and observed the traffic on TCASII and requested a further turn to the left of about another 30 degrees. Traffic passed behind us as departure said he was beginning a descent. It would have been closer if we hadn't had TCASII and departure had not reported him. Would have been nice to have been aware he was at 10500 ft earlier.

Title: B737-300 ACFT IN CLB REQUESTED DEV FOR WX AND WHEN APPROVED CONFLICT RESULTED WITH ANOTHER ACFT. THOUGH OTHER ACFT WAS 800 FT ABOVE AND 2 MI DISTANT, RPTR RECEIVED TCASII.

Narrative: AFTER TKOF AND CLRED TO 10000 FT, JUST PRIOR TO LEVEL OFF, WE REQUESTED A 10-15 DEG TURN TO L TO AVOID A SMALL CELL. DEP APPROVED THE TURN. WHILE IN THE CLB AND TURN, DEP SAID POP-UP TFC CLRED TO DSND. TFC WAS AT 10500 FT AND WE WERE PASSING THROUGH 9700 FT. TRIED TO LEVEL AND OBSERVED THE TFC ON TCASII AND REQUESTED A FURTHER TURN TO THE L OF ABOUT ANOTHER 30 DEGS. TFC PASSED BEHIND US AS DEP SAID HE WAS BEGINNING A DSCNT. IT WOULD HAVE BEEN CLOSER IF WE HADN'T HAD TCASII AND DEP HAD NOT RPTED HIM. WOULD HAVE BEEN NICE TO HAVE BEEN AWARE HE WAS AT 10500 FT EARLIER.
