Narrative:
SID westchester 9 states, climb runway heading to 800 ft then turn right to 320 degrees, maintain 3000 ft, do not exceed 190 KTS until reaching 3000 ft. We were in our right turn to heading 320 degrees, passing 240 degrees and at 3000 ft, accelerating past 220 KTS when N90 asked if we were aware of the speed restr on the departure -- not to exceed 190 KTS until heading 320 degrees. We apologized for any trouble, and immediately slowed to 190 KTS. Upon further review of the SID, we had not violated the SID. The controller stated that they don't want aircraft accelerating past 190 KTS until reaching a heading of 320 degrees because of possible incursion of other airspace and possible conflict with other aircraft. It is my understanding that there was no conflict with other aircraft. But, the SID does state 190 KTS until reaching 3000 ft. If we had violated another agency's airspace it was not deliberate in nature.

Title: FLC ACCELERATES REACHING 3000 FT AS SID INDICATES BUT DEP CTLR SAYS THEY NEED TO REMAIN AT 190 KTS. SID INSTRUCTIONS CONFUSING.
Narrative: SID WESTCHESTER 9 STATES, CLB RWY HDG TO 800 FT THEN TURN R TO 320 DEGS, MAINTAIN 3000 FT, DO NOT EXCEED 190 KTS UNTIL REACHING 3000 FT. WE WERE IN OUR R TURN TO HDG 320 DEGS, PASSING 240 DEGS AND AT 3000 FT, ACCELERATING PAST 220 KTS WHEN N90 ASKED IF WE WERE AWARE OF THE SPD RESTR ON THE DEP -- NOT TO EXCEED 190 KTS UNTIL HDG 320 DEGS. WE APOLOGIZED FOR ANY TROUBLE, AND IMMEDIATELY SLOWED TO 190 KTS. UPON FURTHER REVIEW OF THE SID, WE HAD NOT VIOLATED THE SID. THE CTLR STATED THAT THEY DON'T WANT ACFT ACCELERATING PAST 190 KTS UNTIL REACHING A HDG OF 320 DEGS BECAUSE OF POSSIBLE INCURSION OF OTHER AIRSPACE AND POSSIBLE CONFLICT WITH OTHER ACFT. IT IS MY UNDERSTANDING THAT THERE WAS NO CONFLICT WITH OTHER ACFT. BUT, THE SID DOES STATE 190 KTS UNTIL REACHING 3000 FT. IF WE HAD VIOLATED ANOTHER AGENCY'S AIRSPACE IT WAS NOT DELIBERATE IN NATURE.
