Narrative:
Far part 91.126(C) flap settings, states that, 'except when necessary for training or certification, the PIC of a civil turbojet pwred aircraft must use as a final flap setting the minimum certificated landing flap setting set forth in the approved performance information in the airplane flight manual for the applicable conditions. However, each PIC has the final authority/authorized and responsibility for the safe operation of the pilot's airplane, and may use a different flap setting for that airplane if the pilot determines that it is necessary in the interest of safety.' the pilots in our flight department never land with a reduced flap setting, less than 45 degrees, even when landing on long runways 10000 ft plus, and when the afm performance section has data, speeds and distances for such flap settings. Since the wording of far 91.126(C) uses 'must,' is it a violation of the FARS to land with more flaps than required for the conditions? What is the intent of this regulation? 91.127 and 91.129 also require that the provisions of 91.126 be adhered to.

Title: CAPT OF A CPR CL60 EXECUTIVE JET QUESTIONS SECTION 91 PT 126(C) WITH REGARD TO THE USE OF THE MINIMUM FLAP SETTING FOR LNDG DUE TO THEIR COMPANY POLICY TO NORMALLY USE FULL FLAPS AT ANY TIME NO MATTER HOW LONG THE RWY ACTUALLY IS.
Narrative: FAR PART 91.126(C) FLAP SETTINGS, STATES THAT, 'EXCEPT WHEN NECESSARY FOR TRAINING OR CERTIFICATION, THE PIC OF A CIVIL TURBOJET PWRED ACFT MUST USE AS A FINAL FLAP SETTING THE MINIMUM CERTIFICATED LNDG FLAP SETTING SET FORTH IN THE APPROVED PERFORMANCE INFO IN THE AIRPLANE FLT MANUAL FOR THE APPLICABLE CONDITIONS. HOWEVER, EACH PIC HAS THE FINAL AUTH AND RESPONSIBILITY FOR THE SAFE OP OF THE PLT'S AIRPLANE, AND MAY USE A DIFFERENT FLAP SETTING FOR THAT AIRPLANE IF THE PLT DETERMINES THAT IT IS NECESSARY IN THE INTEREST OF SAFETY.'
