Narrative:

While climbing from rsw on flight XXX, we received an RA on TCASII. After being cleared by ATC to go direct mco, we complied with the RA by leveling off and starting an immediate descent. At the same time, ATC was calling this traffic out to us, we missed the aircraft by 100 ft and less than 1 mi. ATC was talking to the intruding aircraft (a lear jet 35) yet put on a heading for a direct collision course for each other. Our position was 75 DME on the 200 degree radial of mco at XX17. The lear was VFR level at 17500 ft and we were climbing to FL230. The controller seemed to have no concern for the situation we were in. After a conversation with the ATC supervisor on duty, she said the incident would be investigated.

Title: FLC OF AN MLG STOPPED THEIR CLB AND DSNDED IN RESPONSE TO A TCASII RA CAUSED BY A LEAR 35 IN LEVEL FLT 100 FT ABOVE THE ALT IN WHICH THEY WERE CLBING THROUGH. ATC GAVE THEM ADVISORY OF THE VFR LEAR 35 AT THE SAME TIME THAT THE RPTR WAS TAKING EVASIVE ACTION.

Narrative: WHILE CLBING FROM RSW ON FLT XXX, WE RECEIVED AN RA ON TCASII. AFTER BEING CLRED BY ATC TO GO DIRECT MCO, WE COMPLIED WITH THE RA BY LEVELING OFF AND STARTING AN IMMEDIATE DSCNT. AT THE SAME TIME, ATC WAS CALLING THIS TFC OUT TO US, WE MISSED THE ACFT BY 100 FT AND LESS THAN 1 MI. ATC WAS TALKING TO THE INTRUDING ACFT (A LEAR JET 35) YET PUT ON A HDG FOR A DIRECT COLLISION COURSE FOR EACH OTHER. OUR POS WAS 75 DME ON THE 200 DEG RADIAL OF MCO AT XX17. THE LEAR WAS VFR LEVEL AT 17500 FT AND WE WERE CLBING TO FL230. THE CTLR SEEMED TO HAVE NO CONCERN FOR THE SIT WE WERE IN. AFTER A CONVERSATION WITH THE ATC SUPVR ON DUTY, SHE SAID THE INCIDENT WOULD BE INVESTIGATED.
