Narrative:

Location: 50 mi southeast kwinn. En route kwinn-gabes, flight was assigned FL270 for route because of traffic. FL370 was filed. After kwinn we began experiencing light to moderate chop followed by light to intermediate moderate turbulence. Moderate precipitation began appearing at our 12 O'clock, 50 mi. Not wanting any worse turbulence, I instructed the first officer to inform new york commercial radio I was using emergency authority/authorized to deviate northeast of course 30 mi. I then turned northeast and deviated up to 22 mi left of course to avoid the heavy precipitation. Still we encountered up to moderate turbulence. Center came on the frequency and advised us to descend to FL260 for traffic on our left and then cleared us to deviate left of course. We complied and reported back on course by abeam creeq intersection. I did not have the time to request and then wait for center relay to commercial radio for clearance to deviation from course. Experience has shown me that these requests take at least several mins. Supplemental information from acn 395324: 240 NM north gabes intersection, flight was assigned FL270 due to traffic. Filed for FL370 unavailable. After kwinn we began experiencing moderate turbulence, moderate precipitation was at 12 O'clock and 50 mi. To avoid turbulence, exercised emergency authority/authorized to avoid WX and turbulence, and called commercial radio to deviation 30 NM east of course. ZNY came on frequency and cleared us to FL260 for traffic. Maximum deviation was 22 mi east of course 223 mi north of gabes. Notified dispatch via satcom. No injuries incurred to passenger of crew.
