Narrative:
We departed acy with the left air conditioning pack deferred and the right air conditioning pack the sole system for pressurizing the aircraft. Soon after takeoff the right pack began to fail. We referenced company checklists and could not restore the system. We advised ATC that we needed to return to acy. I then contacted dispatch and advised them of our situation and that we were at that time 8000 pounds over landing weight. I asked if we could land overweight or should we burn off fuel. I was advised by company dispatch that a landing at 107000 pounds, (6000 pounds) over landing weight would be acceptable. We then advised acy ATC of our intention to land overweight and that we are declaring an emergency for the overweight landing in order to have crash fire rescue equipment available as a precaution for this non standard procedure and to add a higher level of safety. When all checklists were accomplished and we were down to our target weight I landed the aircraft with no further incidents.

Title: A DC9-40 HAS ONE AIR CONDITIONING PACK AS A DEFERRED ITEM. ON TKOF THE OTHER PACK FAILS. THE CAPT ELECTS TO MAKE AN OVERWEIGHT LNDG AT DEP ARPT, ACY.
Narrative: WE DEPARTED ACY WITH THE L AIR CONDITIONING PACK DEFERRED AND THE R AIR CONDITIONING PACK THE SOLE SYS FOR PRESSURIZING THE ACFT. SOON AFTER TKOF THE R PACK BEGAN TO FAIL. WE REFED COMPANY CHKLISTS AND COULD NOT RESTORE THE SYS. WE ADVISED ATC THAT WE NEEDED TO RETURN TO ACY. I THEN CONTACTED DISPATCH AND ADVISED THEM OF OUR SIT AND THAT WE WERE AT THAT TIME 8000 LBS OVER LNDG WT. I ASKED IF WE COULD LAND OVERWT OR SHOULD WE BURN OFF FUEL. I WAS ADVISED BY COMPANY DISPATCH THAT A LNDG AT 107000 LBS, (6000 LBS) OVER LNDG WT WOULD BE ACCEPTABLE.
