Narrative:
ZNY, bda 336 degree radial, 10 DME. Level 4000 ft, departing bda. Cleared direct targa. Cleared to climb by ZNY. We had a TCASII target just in front of us and 1000 ft above. Asked ZNY if he was sure he wanted us to climb due to our observed traffic. He responded, 'maintain 4000 ft,' and told other traffic to turn left immediately. Traffic continued to descend, which gave us an RA and directed a descent. We followed TCASII RA directive for a 1500 FPM descent, for 300 ft. Then it advised 'monitor vertical speed.' when clear of traffic, we returned to 4000 ft. We advised ATC of our deviation when we did it and of our return to 4000 ft when complete. Supplemental information from acn 416111: at approximately 1500 ft on takeoff, received amended altitude clearance to maintain 4000 ft. ATC then directed conflicting traffic, a westwind, to make an immediate left turn. On return to bos, called center and was advised that the westwind had been cleared to deviate but had made an unexpected 100 degree turn.

Title: A B757 DEP BDA IS GIVEN CLB CLRNC WHILE NEAR A DSNDING, MANEUVERING WESTWIND. ATC HAD GIVEN THE WESTWIND PERMISSION TO DEVIATE BUT HAD NOT TAKEN THE CLB OF THE B757 INTO CONSIDERATION.
Narrative: ZNY, BDA 336 DEG RADIAL, 10 DME. LEVEL 4000 FT, DEPARTING BDA. CLRED DIRECT TARGA. CLRED TO CLB BY ZNY. WE HAD A TCASII TARGET JUST IN FRONT OF US AND 1000 FT ABOVE. ASKED ZNY IF HE WAS SURE HE WANTED US TO CLB DUE TO OUR OBSERVED TFC. HE RESPONDED, 'MAINTAIN 4000 FT,' AND TOLD OTHER TFC TO TURN L IMMEDIATELY. TFC CONTINUED TO DSND, WHICH GAVE US AN RA AND DIRECTED A DSCNT. WE FOLLOWED TCASII RA DIRECTIVE FOR A 1500 FPM DSCNT, FOR 300 FT. THEN IT ADVISED 'MONITOR VERT SPD.'
