Narrative:
We were cleared to and maintaining 11000 ft, having been advised there was a commuter climbing above us. They had just vacated 11000 ft, and were climbing through 11500 ft or so (maybe 11600 ft) when we flew under them along the same general route of flight. Our TCASII gave a descend command, which I did not comply with because I knew why we had gotten it. I think the controller may not have allowed enough time and distance for the commuter to climb above us before we arrived in that airspace at a faster speed.

Title: G5 CREW RECEIVES TCASII RA AS THEY PASS BENEATH CLBING ACR ACFT IN N90 AIRSPACE.
Narrative: WE WERE CLRED TO AND MAINTAINING 11000 FT, HAVING BEEN ADVISED THERE WAS A COMMUTER CLBING ABOVE US. THEY HAD JUST VACATED 11000 FT, AND WERE CLBING THROUGH 11500 FT OR SO (MAYBE 11600 FT) WHEN WE FLEW UNDER THEM ALONG THE SAME GENERAL RTE OF FLT. OUR TCASII GAVE A DSND COMMAND, WHICH I DID NOT COMPLY WITH BECAUSE I KNEW WHY WE HAD GOTTEN IT. I THINK THE CTLR MAY NOT HAVE ALLOWED ENOUGH TIME AND DISTANCE FOR THE COMMUTER TO CLB ABOVE US BEFORE WE ARRIVED IN THAT AIRSPACE AT A FASTER SPD.
