Narrative:
We departed sjc sbound on the loop 9 departure. The captain was flying. The autoplt was engaged with LNAV. ATC gave us the clearance 'turn right to the sjc VOR, cross it at 12000 ft, then climb and maintain FL230.' while turning, the autoplt rolled out 30 degrees prematurely as if it was on an intercept. The captain disconnected the autoplt and hand flew the aircraft. In the meantime he had dialed in 230 degrees in the MCP window for the next higher altitude. The FMS was programmed to level at 12000 ft until the VOR, but when he disconnected the autoplt we received no aural warning approaching 12000 ft because FL230 was now set. The aircraft climbed to approximately 15000 ft about 2 mi prior to the VOR. ATC called and queried us and then cleared us to FL230. In the future, I would not engage the FMS until clear of the departure area and maybe even cruise. I'm new to the FMS and I don't think it's all that great.

Title: A B737-300 CLBS ABOVE THE ASSIGNED XING ALT PRIOR TO THE SJC VOR DURING THE LOOP 9 DEP PROC.
Narrative: WE DEPARTED SJC SBOUND ON THE LOOP 9 DEP. THE CAPT WAS FLYING. THE AUTOPLT WAS ENGAGED WITH LNAV. ATC GAVE US THE CLRNC 'TURN R TO THE SJC VOR, CROSS IT AT 12000 FT, THEN CLB AND MAINTAIN FL230.' WHILE TURNING, THE AUTOPLT ROLLED OUT 30 DEGS PREMATURELY AS IF IT WAS ON AN INTERCEPT. THE CAPT DISCONNECTED THE AUTOPLT AND HAND FLEW THE ACFT. IN THE MEANTIME HE HAD DIALED IN 230 DEGS IN THE MCP WINDOW FOR THE NEXT HIGHER ALT. THE FMS WAS PROGRAMMED TO LEVEL AT 12000 FT UNTIL THE VOR, BUT WHEN HE DISCONNECTED THE AUTOPLT WE RECEIVED NO AURAL WARNING APCHING 12000 FT BECAUSE FL230 WAS NOW SET. THE ACFT CLBED TO APPROX 15000 FT ABOUT 2 MI PRIOR TO THE VOR. ATC CALLED AND QUERIED US AND THEN CLRED US TO FL230. IN THE FUTURE, I WOULD NOT ENGAGE THE FMS UNTIL CLR OF THE DEP AREA AND MAYBE EVEN CRUISE. I'M NEW TO THE FMS AND I DON'T THINK IT'S ALL THAT GREAT.
