Narrative:
On departure we were given climb to 3000 ft. After 1 min, controller issued climb to 14000 ft with 8000 ft restr at pom. We complied with this. Just over pom VOR, we received an RA to climb and we noticed a target on the TCASII 200-300 ft above us at about 3-4 mi. I immediately responded to the RA and began an abrupt climb to 14000 ft. We flew above the other aircraft 200-300 ft as I remember. We never saw the other aircraft. The controller said that he had tried to contact us, we believe that he was calling us at the same time we were getting our first TA. I heard him call again, but I was now responding to the RA. I don't know why the controller allowed either us or them to be in that situation. All I can tell you is our side of what happened.

Title: DEPARTING B737 FLC CONFLICTED WITH UNKNOWN SMA ACFT OVER POM AT APPROX 8000 FT.
Narrative: ON DEP WE WERE GIVEN CLB TO 3000 FT. AFTER 1 MIN, CTLR ISSUED CLB TO 14000 FT WITH 8000 FT RESTR AT POM. WE COMPLIED WITH THIS. JUST OVER POM VOR, WE RECEIVED AN RA TO CLB AND WE NOTICED A TARGET ON THE TCASII 200-300 FT ABOVE US AT ABOUT 3-4 MI. I IMMEDIATELY RESPONDED TO THE RA AND BEGAN AN ABRUPT CLB TO 14000 FT. WE FLEW ABOVE THE OTHER ACFT 200-300 FT AS I REMEMBER. WE NEVER SAW THE OTHER ACFT. THE CTLR SAID THAT HE HAD TRIED TO CONTACT US, WE BELIEVE THAT HE WAS CALLING US AT THE SAME TIME WE WERE GETTING OUR FIRST TA. I HEARD HIM CALL AGAIN, BUT I WAS NOW RESPONDING TO THE RA. I DON'T KNOW WHY THE CTLR ALLOWED EITHER US OR THEM TO BE IN THAT SIT. ALL I CAN TELL YOU IS OUR SIDE OF WHAT HAPPENED.
