Narrative:

We (aircraft X) were climbing out of dca on an IFR flight plan in VMC. We were assigned a heading and climb to 9000 ft. I called traffic at 12 O'clock position and called up TCASII display manually. Traffic was 1500-2000 ft higher than us and turning to the right across our nose. We shallowed our climb in response to TCASII TA/RA. An air carrier Y flight called dca radar and said he was in a TCASII RA climb to 10000 ft. Before our RA maneuver, ATC called traffic at 12 O'clock position and at 9000 ft (same altitude as us). I said 'traffic in sight.' I was not told to 'maintain visual separation' or any words to that effect. The air carrier Y complained to ATC about our close proximity and his TCASII RA. ATC said we (aircraft X) were on a river departure and were maintaining visual separation. Fortunately it was VMC and I saw the crossing traffic before TCASII went to TA/RA. There was a breakdown in communications between ATC, us, and the air carrier flight. Both flts were assigned 9000 ft MSL on converging radar vectors. TCASII worked.

Title: DEPARTING CPR JET AND ARRIVING ACR FLC'S INITIATE TCASII EVASIVE MANEUVER WHEN COMING INTO CONFLICT.

Narrative: WE (ACFT X) WERE CLBING OUT OF DCA ON AN IFR FLT PLAN IN VMC. WE WERE ASSIGNED A HDG AND CLB TO 9000 FT. I CALLED TFC AT 12 O'CLOCK POS AND CALLED UP TCASII DISPLAY MANUALLY. TFC WAS 1500-2000 FT HIGHER THAN US AND TURNING TO THE R ACROSS OUR NOSE. WE SHALLOWED OUR CLB IN RESPONSE TO TCASII TA/RA. AN ACR Y FLT CALLED DCA RADAR AND SAID HE WAS IN A TCASII RA CLB TO 10000 FT. BEFORE OUR RA MANEUVER, ATC CALLED TFC AT 12 O'CLOCK POS AND AT 9000 FT (SAME ALT AS US). I SAID 'TFC IN SIGHT.' I WAS NOT TOLD TO 'MAINTAIN VISUAL SEPARATION' OR ANY WORDS TO THAT EFFECT. THE ACR Y COMPLAINED TO ATC ABOUT OUR CLOSE PROX AND HIS TCASII RA. ATC SAID WE (ACFT X) WERE ON A RIVER DEP AND WERE MAINTAINING VISUAL SEPARATION. FORTUNATELY IT WAS VMC AND I SAW THE XING TFC BEFORE TCASII WENT TO TA/RA. THERE WAS A BREAKDOWN IN COMS BTWN ATC, US, AND THE ACR FLT. BOTH FLTS WERE ASSIGNED 9000 FT MSL ON CONVERGING RADAR VECTORS. TCASII WORKED.
