Narrative:

#2 pack deferred, restr to FL250. Captain's seat back recline deferred also. Every time I move I had to re-adjust the seat. On departure, got rerted by ATC from hou-iah-cqy-dfw to hou-LOA-altitude-jen-dfw. Had to scramble to figure out if we could accept the new ATC route (ostensibly for traffic) with the meager fuel load on board. Figured that we could, but wanted to go higher to reduce fuel burn, forgetting due to workload that we had to stay at or below FL250. Got clearance and went to FL280. At FL280, ATC noted that we had originally been restr to FL250 and asked if we had the problem fixed. I said that yes, we're ok, but we'd like to go back down to FL240. He cleared us back down and asked if our fuel status would be ok at that altitude and I said yes. Controller did not seem to have any problems with this whole thing. I, of course, feel like a complete idiot.

Title: CAPT OF AN EMBRAER EMB145 EXCEEDED AN MEL ALT RESTR WHEN HE REQUESTED AND RECEIVED CLRNC TO A HIGHER ALT THAN THAT TO WHICH HE WAS MEL'ED RESTR.

Narrative: #2 PACK DEFERRED, RESTR TO FL250. CAPT'S SEAT BACK RECLINE DEFERRED ALSO. EVERY TIME I MOVE I HAD TO RE-ADJUST THE SEAT. ON DEP, GOT RERTED BY ATC FROM HOU-IAH-CQY-DFW TO HOU-LOA-ALT-JEN-DFW. HAD TO SCRAMBLE TO FIGURE OUT IF WE COULD ACCEPT THE NEW ATC RTE (OSTENSIBLY FOR TFC) WITH THE MEAGER FUEL LOAD ON BOARD. FIGURED THAT WE COULD, BUT WANTED TO GO HIGHER TO REDUCE FUEL BURN, FORGETTING DUE TO WORKLOAD THAT WE HAD TO STAY AT OR BELOW FL250. GOT CLRNC AND WENT TO FL280. AT FL280, ATC NOTED THAT WE HAD ORIGINALLY BEEN RESTR TO FL250 AND ASKED IF WE HAD THE PROB FIXED. I SAID THAT YES, WE'RE OK, BUT WE'D LIKE TO GO BACK DOWN TO FL240. HE CLRED US BACK DOWN AND ASKED IF OUR FUEL STATUS WOULD BE OK AT THAT ALT AND I SAID YES. CTLR DID NOT SEEM TO HAVE ANY PROBS WITH THIS WHOLE THING. I, OF COURSE, FEEL LIKE A COMPLETE IDIOT.
