Narrative:

Captain flying, autoplt engaged, established at FL180 on J37. ZNY cleared us to FL240, which we acknowledged and began climb to FL240. A few seconds later, ZNY issued us a frequency change to ZDC on 121.02, which we also acknowledged. We called ZDC and reported leaving FL195 for FL240 which they acknowledged. At FL224, TCASII issued a TA. I disconnected autoplt and autothrottles, reduced my rate of climb, and a few seconds later I observed opposite direction traffic (aircraft Y) pass overhead. ATC asked us what flight level we were at and we replied 'FL225.' after a few seconds of radio silence, ATC told us to climb to FL240, which we acknowledged. Flight continued to destination uneventfully.

Title: A LOSS OF SEPARATION OCCURS WHEN ZDC ARTCC RADAR CTLR PERMITS FLT TO CLB THROUGH OCCUPIED ALT.

Narrative: CAPT FLYING, AUTOPLT ENGAGED, ESTABLISHED AT FL180 ON J37. ZNY CLRED US TO FL240, WHICH WE ACKNOWLEDGED AND BEGAN CLB TO FL240. A FEW SECONDS LATER, ZNY ISSUED US A FREQ CHANGE TO ZDC ON 121.02, WHICH WE ALSO ACKNOWLEDGED. WE CALLED ZDC AND RPTED LEAVING FL195 FOR FL240 WHICH THEY ACKNOWLEDGED. AT FL224, TCASII ISSUED A TA. I DISCONNECTED AUTOPLT AND AUTOTHROTTLES, REDUCED MY RATE OF CLB, AND A FEW SECONDS LATER I OBSERVED OPPOSITE DIRECTION TFC (ACFT Y) PASS OVERHEAD. ATC ASKED US WHAT FLT LEVEL WE WERE AT AND WE REPLIED 'FL225.' AFTER A FEW SECONDS OF RADIO SILENCE, ATC TOLD US TO CLB TO FL240, WHICH WE ACKNOWLEDGED. FLT CONTINUED TO DEST UNEVENTFULLY.
