Narrative:
On final approach to key west with landing gear down and 2 notches (25 degrees) flaps set, final flaps (45 degrees) was selected. The flaps did not move. The flap handle moved, the electronic selector indicated 45 degrees was commanded, but no movement or fault indication occurred. A go around was made and we checked for a solution. There was no checklist for this type of indication. The landing data for flaps 25 degrees suggested we were several hundred pounds overweight for a legal landing. If this were an alternate airfield the flaps 25 degree landing would be ok. Because we were out of radio range to confirm with our company, outside help was unavailable. Our fuel level didn't allow for a legal alternate (not alternate was required) so we declared an emergency after notifying the crew and passenger and key west tower. We landed without incident with flaps 25 degrees.

Title: AM EMB120 FLT LANDS OVERWT WITH FLAPS 25 DEGS WHEN THE FLAPS FAIL TO DEPLOY TO THEIR FULL SETTING OF 45 DEGS WHILE ON APCH TO EYW, FL.
Narrative: ON FINAL APCH TO KEY WEST WITH LNDG GEAR DOWN AND 2 NOTCHES (25 DEGS) FLAPS SET, FINAL FLAPS (45 DEGS) WAS SELECTED. THE FLAPS DID NOT MOVE. THE FLAP HANDLE MOVED, THE ELECTRONIC SELECTOR INDICATED 45 DEGS WAS COMMANDED, BUT NO MOVEMENT OR FAULT INDICATION OCCURRED. A GAR WAS MADE AND WE CHKED FOR A SOLUTION. THERE WAS NO CHKLIST FOR THIS TYPE OF INDICATION. THE LNDG DATA FOR FLAPS 25 DEGS SUGGESTED WE WERE SEVERAL HUNDRED LBS OVERWT FOR A LEGAL LNDG. IF THIS WERE AN ALTERNATE AIRFIELD THE FLAPS 25 DEG LNDG WOULD BE OK. BECAUSE WE WERE OUT OF RADIO RANGE TO CONFIRM WITH OUR COMPANY, OUTSIDE HELP WAS UNAVAILABLE. OUR FUEL LEVEL DIDN'T ALLOW FOR A LEGAL ALTERNATE (NOT ALTERNATE WAS REQUIRED) SO WE DECLARED AN EMER AFTER NOTIFYING THE CREW AND PAX AND KEY WEST TWR. WE LANDED WITHOUT INCIDENT WITH FLAPS 25 DEGS.
