Narrative:
We were in cavu, uncontrolled airspace, in contact with the ack tower who had us on radar during our descent. Tower reported 2 aircraft. We confirmed both in sight. Tower was not speaking to departing commuter flight. Tower informed us that commuter would pass behind us. We recognized that he was cutting in front of us, and didn't see us. We turned to the right without a problem. Commuter pilot called tower and was rude to the operator. Suggest that commuters monitor tower when 3 mi from airport.

Title: AN ARRIVING PA46 MALIBU HAS AN NMAC WITH A DEP COMMUTER C402 IN CLASS D AIRSPACE AT ACK, MA.
Narrative: WE WERE IN CAVU, UNCTLED AIRSPACE, IN CONTACT WITH THE ACK TWR WHO HAD US ON RADAR DURING OUR DSCNT. TWR RPTED 2 ACFT. WE CONFIRMED BOTH IN SIGHT. TWR WAS NOT SPEAKING TO DEPARTING COMMUTER FLT. TWR INFORMED US THAT COMMUTER WOULD PASS BEHIND US. WE RECOGNIZED THAT HE WAS CUTTING IN FRONT OF US, AND DIDN'T SEE US. WE TURNED TO THE R WITHOUT A PROB. COMMUTER PLT CALLED TWR AND WAS RUDE TO THE OPERATOR. SUGGEST THAT COMMUTERS MONITOR TWR WHEN 3 MI FROM ARPT.
