Narrative:

While taxiing out for takeoff, the lead flight attendant stuck her head in the cockpit and advised us that 2 passenger were up and had gone to the lavatory. I (so) advised the captain. He did not acknowledge me, so I advised him again and he turned to look at me and said 'ok,' but he continued taxiing. The airport was changing runways, and this required further taxiing. One passenger returned to her seat. I advised the captain of this and added 'but 1 passenger is still in the lavatory.' the captain nodded his head in the affirmative, and continued taxiing. In retrospect, I should have been more assertive and reminded the captain that the FARS prevent us from taxiing with passenger up. At the time it seemed so obvious, I did not feel I had to repeat the FARS.

Title: CAPT CONTINUED TAXIING OUT AFTER BEING ADVISED THAT 2 PAX WERE OUT OF THEIR SEATS GOING TO THE LAVATORY.

Narrative: WHILE TAXIING OUT FOR TKOF, THE LEAD FLT ATTENDANT STUCK HER HEAD IN THE COCKPIT AND ADVISED US THAT 2 PAX WERE UP AND HAD GONE TO THE LAVATORY. I (SO) ADVISED THE CAPT. HE DID NOT ACKNOWLEDGE ME, SO I ADVISED HIM AGAIN AND HE TURNED TO LOOK AT ME AND SAID 'OK,' BUT HE CONTINUED TAXIING. THE ARPT WAS CHANGING RWYS, AND THIS REQUIRED FURTHER TAXIING. ONE PAX RETURNED TO HER SEAT. I ADVISED THE CAPT OF THIS AND ADDED 'BUT 1 PAX IS STILL IN THE LAVATORY.' THE CAPT NODDED HIS HEAD IN THE AFFIRMATIVE, AND CONTINUED TAXIING. IN RETROSPECT, I SHOULD HAVE BEEN MORE ASSERTIVE AND REMINDED THE CAPT THAT THE FARS PREVENT US FROM TAXIING WITH PAX UP. AT THE TIME IT SEEMED SO OBVIOUS, I DID NOT FEEL I HAD TO REPEAT THE FARS.
