Narrative:
Northbound on UL315 north of logol intersection, during a climb from FL310 to FL390, a sbound aircraft was observed ahead of us approximately 35-40 mi ahead, and east of us by 10 mi (east off course) and the airplane was at FL370. We turned west to further increase our horizontal distance, but the sbound airplane made a turn towards us to the west and was the cause of the RA and near miss. We acquired the sbound flight both on TCASII, and visually. The sbound aircraft never saw us visually until after passing below us, but he made a turn based solely on his TCASII display, not visual.

Narrative: NBOUND ON UL315 N OF LOGOL INTXN, DURING A CLB FROM FL310 TO FL390, A SBOUND ACFT WAS OBSERVED AHEAD OF US APPROX 35-40 MI AHEAD, AND E OF US BY 10 MI (E OFF COURSE) AND THE AIRPLANE WAS AT FL370. WE TURNED W TO FURTHER INCREASE OUR HORIZ DISTANCE, BUT THE SBOUND AIRPLANE MADE A TURN TOWARDS US TO THE W AND WAS THE CAUSE OF THE RA AND NEAR MISS.
